Terms & Conditions

Quick Things to Know Before You Bid

  1. Unless this auction states otherwise, buyers have 14 calendar days after the auction closes to collect purchases by appointment at our gallery, 28 Main Street, Oakville, CT 06779. Gallery pickup appointments are generally available Tuesday through Saturday, 11:00 a.m. to 4:00 p.m. Eastern Time. The auction listing and winning-bidder email will state the final available appointment date.
  2. Storage charges begin on day 15 after the auction closes. Purchases still uncollected 30 calendar days after the auction closes will be treated as abandoned under these terms, subject to applicable notice and disposition requirements. Book an available appointment before the deadline; an alternate arrangement is effective only if East-Wing confirms it in writing.
  3. East-Wing does not pack or ship purchases. Buyers who need shipping must arrange it with a third-party provider, complete the online Shipping Release Form, and have the shipper collect the items within the 14-day pickup period.
  4. Read all terms, lot descriptions, condition information, and pickup instructions before bidding. Placing a bid constitutes acceptance of these terms.

Gallery Pickup and Removal

All purchases must be collected from East-Wing Estate Sales, LLC, 28 Main Street, Oakville, CT 06779, unless the auction listing expressly identifies another location. Unless this auction states otherwise, buyers have 14 calendar days after the auction closes to arrange and complete pickup. Pickup is by appointment only, generally Tuesday through Saturday, 11:00 a.m. to 4:00 p.m. Eastern Time, during that 14-day period. Auction-specific instructions control if they differ. The auction listing and winning-bidder email will identify the final available appointment date on or before the 14-day deadline. If the 14th day falls on a Sunday or Monday, the preceding Saturday is normally the final available appointment day unless East-Wing confirms another arrangement in writing. Book early enough to obtain an appointment; an unappointed arrival does not guarantee access or assistance.

Invoices and any applicable storage or other charges must be paid in full before property is released. Buyers are responsible for arranging timely pickup, including pickup by a person they authorize. If you cannot collect your purchase within 14 calendar days after the auction closes, contact us before bidding. Any exception must be confirmed by East-Wing in writing.

Beginning on day 15 after the auction closes, a storage charge of $5 per lot per day applies to uncollected purchases. Property still uncollected 30 calendar days after the auction closes will be treated as abandoned under these terms. East-Wing may pursue resale or other lawful disposition only after providing any notice and following any procedures required by applicable law. The 30-day deadline does not by itself transfer ownership of paid property or waive any rights that cannot lawfully be waived. Storage and other outstanding charges remain payable to the extent allowed by law.

Removal is at the buyer's expense and risk. Bring appropriate help, packing materials, tools, lifting equipment, and a suitable vehicle. East-Wing does not provide packing supplies or moving services. Staff may stop a removal that they reasonably believe risks injury or damage until the buyer makes suitable arrangements. Buyers are responsible for damage they or their representatives cause to the gallery or other property during removal.

Third-Party Shipping and Release

East-Wing does not provide in-house packing or shipping. Shipping, when available for a lot, is arranged directly between the buyer and an independent third-party shipper. Shippers listed by East-Wing are options for the buyer's convenience; they are not East-Wing's agents. Obtain a quote directly from the shipper before bidding if shipping cost or availability affects your decision.

To authorize release to a shipper, complete the online Shipping Release Form at www.eastwingestates.com/shipping. The authorization must match the buyer's invoice and account information. The buyer must notify the chosen shipper and make and pay for all shipping arrangements. The shipper must collect the items within 14 calendar days after the auction closes, unless East-Wing confirms an extension in writing. Third-party pickups are by appointment during the gallery's Tuesday-through-Saturday pickup hours, 11:00 a.m. to 4:00 p.m. Eastern Time, and must be scheduled with East-Wing at least 48 hours in advance. Arrange shipping early enough for the shipper to meet that deadline. All invoices and accrued charges must be paid before release.

East-Wing does not set the shipper's prices and is not responsible for the shipper's packing, materials, insurance, transit, delivery, delays, loss, damage, or customer service. Responsibility for those services and any related claims rests with the buyer and the chosen shipper. East-Wing's responsibility for custody ends when the property is released to the authorized shipper, to the extent permitted by law. Submission of a shipping request does not suspend pickup, storage, or abandonment deadlines.

Absentee Bidding

When available for this auction, East-Wing accepts absentee bids by phone request, mail, or in person. Requests must be received at least 24 hours before the auction begins and are subject to East-Wing's acceptance and staff availability. A valid credit card and complete bidder registration may be required before a bid is accepted. For mailed bids, call to confirm receipt; mailing a bid does not by itself establish that we received or accepted it.

Send mailed bids to East-Wing Estate Sales, LLC, 28 Main Street, Oakville, CT 06779. Include your name and contact details, the auction name, each lot number, and your maximum bid for each lot. East-Wing will endeavor to bid on your behalf at the lowest amount needed under the applicable increments and competing bids, up to your stated maximum. If identical maximum absentee bids compete, priority generally goes to the bid received and accepted first, subject to the auctioneer's determination and any applicable platform rules. Absentee bids are confidential except as needed to administer or resolve a sale. This service is offered as a convenience; East-Wing is not responsible for a bid that is not received or executed because of an error, delay, or technical failure, to the extent permitted by law.

Telephone Bidding

When telephone bidding is offered for a lot, lines are limited and assigned on a first-come, first-served basis. Requests must be received and confirmed by East-Wing at least 24 hours before the auction begins. Request condition information before reserving a line. East-Wing will call only the confirmed number or numbers provided for the sale. If your availability is uncertain, consider placing an absentee bid. Overseas telephone bidders must also provide a backup absentee bid for use if the telephone connection fails.

Confirm your telephone number and the lots requested before the auction, and notify us promptly of any proposed change. East-Wing cannot guarantee a telephone connection or that a call will be completed before bidding on a lot ends. Telephone bids are subject to the auctioneer's acceptance and discretion. Telephone bidding is offered as a convenience and is at the bidder's risk; East-Wing is not responsible for connection failures, misunderstood instructions, or bids that cannot be placed, to the extent permitted by law.

Reserves and Bidding

Some lots may have a confidential reserve agreed upon by East-Wing and the consignor. For lots sold with a reserve, East-Wing may bid on the consignor's behalf up to, but not above, the reserve. If bidding does not reach the reserve, the lot may remain unsold. East-Wing may, with the consignor's approval, later offer the lot to an interested bidder; no sale results unless the bidder accepts that offer.

All bids are subject to the auctioneer's determination. East-Wing may reject a bid, resolve a bidding dispute, pass a lot, or reopen or reoffer a lot when appropriate, subject to applicable law and platform rules.

Payment

Invoices are due in full within five days after the auction closes. Invoices are generally emailed after the sale. For eligible purchases made through bid.eastwingestates.com, the website automatically charges the card on file 72 hours after the auction ends if the invoice remains unpaid. Buyers who want the eligible payment-method discount described below must arrange and complete the qualifying payment before that automatic charge. Other online platforms may process eligible unpaid invoices under their own payment schedules; for example, LiveAuctioneers offers an optional automatic charge for invoices remaining unpaid for 72 hours. An attempted or pending charge does not extend the payment deadline. For a card payment taken by phone, the billing information must match the cardholder's account information.

For invoices of $5,000 or more, East-Wing may require payment by bank wire, Zelle, Venmo, or cash. For invoices over $15,000, payment must be by bank wire or cash. Contact East-Wing directly for current wire instructions. East-Wing may decline, reverse, or refund a card payment and require another permitted method when necessary to verify the transaction. Property will not be released until payment has cleared and any required verification is complete.

For gold, silver, jewelry, and other high-value purchases over $300, East-Wing may require bank wire, Zelle, cash, or certified bank check instead of a card. Purchases over $2,500 in this category may require bank wire or cash. East-Wing may make an exception for an established buyer after reviewing the account. These purchases may be held for up to 10 business days for payment clearance and identity verification. If an East-Wing-imposed hold prevents release within the 14-day pickup period, East-Wing will provide a revised release deadline in writing; storage charges will not accrue solely because of that hold. Buyers remain responsible for arranging pickup or shipping after release is authorized.

Buyer's Premium and Sales Tax

For bids placed through bid.eastwingestates.com, a 25% buyer's premium is added to each lot's hammer price. This premium is reduced by two percentage points, to 23%, when the invoice is paid in full by cash, bank wire, Zelle, or cashier's check, where that method is permitted under the Payment section, before an automatic card charge is processed. The discount applies to the buyer's premium, not the hammer price, and is unavailable for card payments. Bids placed through other online bidding platforms are subject to a 28% buyer's premium, with no payment-method discount under these terms. Any buyer's premium for direct absentee or telephone bids will be stated in the auction's bidding instructions.

Sales tax is applied where required by law to the taxable invoice amount, including the buyer's premium where applicable. A buyer seeking a resale or other exemption must provide a properly completed, applicable certificate and any supporting information before the sale is invoiced. The name and business information must correspond to the purchasing account. East-Wing will apply an exemption only after reviewing and accepting the documentation.

Condition, Descriptions, and Limited Rescission

Inspect lots and request any needed condition information before bidding. Condition reports and catalog descriptions are prepared in good faith from available information, but they may not identify every defect or alteration. Terms such as “appears to,” “possibly,” “probably,” and “attributed to” express opinion, not a definitive attribution. Except for the limited written-description remedy stated below and any rights that cannot lawfully be excluded, property is sold AS IS, WHERE IS, and sales are final. Oral statements do not amend the written catalog description or these terms.

If the original purchaser believes that an affirmative statement of age, authenticity, condition, genuineness, quantity, period, culture, source, or origin in East-Wing's written lot description or a written condition report supplied for the lot was materially inaccurate and materially affected the lot's value, the purchaser must notify East-Wing in writing within 30 days after the auction date, regardless of when the lot is delivered. The notice must identify the disputed statement and provide supporting evidence. The purchaser must obtain East-Wing's authorization before returning the lot and, if authorized, return it within five days after authorization in the condition in which it was sold.

If East-Wing verifies the claim, it will rescind the sale and refund the hammer price, buyer's premium, and applicable sales tax paid for that lot. Shipping, transport, insurance, and other buyer expenses are not refunded. This limited remedy belongs only to the original purchaser and cannot be transferred. It is the exclusive contractual remedy for a qualifying written-description claim, to the extent permitted by law; it does not limit rights that cannot lawfully be waived.

Withdrawal of Property

East-Wing may withdraw a lot before it is sold, subject to applicable law and platform rules.
