PICKING UP YOUR PURCHASES
All items must be picked up at East-Wing Estate Sales, LLC, 28 Main Street, Oakville, CT 06779, unless otherwise stated in the auction listing.

Pickups are strictly by appointment only and are scheduled during the Tuesday through Saturday following the auction, between 10:00 AM and 3:00 PM EST. Winning bidders will receive an email after the auction closes containing instructions and a link to schedule a pickup appointment.

A storage fee of $5 per lot, per day will be applied to any items not picked up by the end of the final pickup day (Saturday). Storage fees accrue automatically and must be paid in full before items will be released. Storage fees do not pause or extend abandonment deadlines.

Buyers are responsible for bringing any and all necessary tools, equipment, packing materials, and labor required to safely remove their purchases. No supplies, tools, or moving assistance are provided on-site.

East-Wing Estate Sales is not accountable for missed pickups. Unscheduled arrivals may encounter delays or the gallery being closed.

BUYER RESPONSIBILITY – NO EXCUSES
Pickup or shipping of purchased items is 100% the Buyer’s responsibility.

East-Wing Estate Sales is not responsible for missed pickups, missed shipping appointments, shipper delays, illness, travel issues, personal emergencies, or any other circumstance. These situations do not excuse non-pickup.

Buyers are adults and are expected to communicate proactively. If an issue arises, the Buyer must contact East-Wing Estate Sales before pickup, storage, or abandonment deadlines expire.

ABANDONMENT – NO NOTICE, NO REFUNDS
Any item not picked up or not released to an approved third-party shipper within fourteen (14) days after the close of the pickup window will be considered abandoned.

Abandoned items will be resold, donated, or otherwise disposed of at the sole discretion of East-Wing Estate Sales, without notice to the Buyer.

No refunds, credits, compensation, or reimbursement of any kind will be issued for abandoned items, regardless of reason or circumstance.

COMMUNICATION & NOTIFICATIONS
All buyer communication is conducted via email only.

East-Wing Estate Sales will not call, text, or otherwise attempt to contact Buyers regarding pickup reminders, storage fees, abandonment deadlines, or shipping coordination.

Buyers are advised to add info@eastwingestates.com to their contact list to prevent emails from being filtered as spam. Failure to receive, see, or read an email is not a valid excuse and does not alter Buyer responsibility.

TERMS OF PICK-UP, REMOVAL & LIABILITY
Removal shall be at the sole expense, risk, and liability of the Buyer. There is no moving assistance provided. Buyers must be adequately prepared to safely remove their items.

If at any time East-Wing staff determines that removal presents a risk to persons or property, removal will be stopped until proper arrangements are made.

If the Buyer cannot safely remove items within the pickup window, the items may be forfeited and treated as abandoned with no refund.

Any damage caused to the premises during removal is the Buyer’s sole responsibility and will be billed accordingly.

SHIPPING
East-Wing Estate Sales does not provide shipping services. Buyers requiring shipping must independently arrange third-party shipping and complete a shipping release form before items can be released.

East-Wing Estate Sales works with several reputable local third-party shipping companies who regularly pick up directly from our gallery. These companies are listed on our shipping information page. Use of these shippers is optional and remains solely between the Buyer and the shipper.

More shipping information and the required release form are available at: www.eastwingestates.com/shipping

Not completing the online release form before the end of the abandonment period will cause the invoice to be marked abandoned and donated/resold without notice.

ABSENTEE BIDS & RESERVES
We accept absentee bids by phone (subject to availability), by mail, or in person. Absentee bids need to be requested no later than 24 hours before the auction. We require a valid credit card to be placed on file before any absentee bids can be accepted. If you mail in your absentee bids, please call to confirm that we received them.

All absentee bidding is managed as though you are in attendance. We will bid on your behalf at the bidding increments just above where the competition stops. Please check these increments before placing bids to understand where bids may end up. All absentee bids will start at the listed starting bid unless there are two or more competing absentee bids at a higher price, in which case we will place your bid at the next highest bidding increment.

Because of the way our bidding is structured, identical absentee bids may occur; the winning bid will go to the bidder who placed/sent the absentee bid first. Absentee bidder names and bids are held in strict confidence, disclosed only in the event of a question after the sale. Absentee bidding is a convenience offered to customers and while we will make every effort to execute instructions, East-Wing Estate Sales is not liable or responsible for any errors or failure to do so.

Please send mail-in bids or place in-person bids at:
East-Wing Estate Sales, LLC
28 Main Street
Oakville, CT 06779

Be sure to include all of your information, the auction name, the lot numbers you wish to bid on, and the maximum bid you would like to place on each lot.

A reserve is the confidential minimum price established between the auctioneer and the consignor. East-Wing may implement a reserve on a particular lot by bidding on behalf of the consignor up to the reserve price. If bidding fails to reach the reserve price, the lot may be bought-in and the highest underbid brought to the attention of the consignor for consideration. If the consignor decides to sell the item at the highest offered underbid, we may reach out to the bidder and offer the lot at the underbid price.

PHONE BIDDING
When telephone bidding is available, telephone bid lines are given on a first-come, first-served basis. All requests for phone bids must be placed 24 hours before the auction. If you need condition reports or more information on a particular lot, contact the auctioneer prior to requesting the phone bid.

At the time of the auction we will call you at the phone number(s) given ONLY. If you are unsure where you or your agent will be during the sale, we recommend leaving absentee bids instead. All requests for overseas phone bids must be accompanied by absentee bids, which will be executed on the Buyer’s behalf should there be problems with telephone connections. Your phone number and lots will be confirmed before the auction. Please do not change your phone number after confirmation; if you do, East-Wing Estate Sales will not be responsible for any breakdown in communications.

Bids are placed on the phone at the sole discretion of East-Wing Estate Sales and at the caller’s risk. Telephone bidding is a convenience offered to customers and while we will make every effort to execute instructions, East-Wing is not liable or responsible for any errors or failure to do so.

PAYMENT
All invoices must be paid in full no later than five (5) days after the close of the auction. Invoices for successful bidders will be sent out the evening of the auction close.

If we have a credit card on file and your invoice total is under $5,000 USD, it will be automatically billed after the close of the auction. For payments taken over the phone, your billing address registered to your account must match the card you are providing, with no exceptions.

For any invoice greater than $5,000 USD, payment must be made by bank wire, Zelle, certified check, or cash. For invoice totals over $15,000 USD, payments can only be made by bank wire or cash. Contact us for wire instructions.

LiveAuctioneers customers will have their cards billed automatically 72 hours after the close of the auction, or you can make a payment using their LivePayments system anytime.

PURCHASES OF GOLD & SILVER
Due to an increased number of fraudulent accounts and chargebacks, special payment and verification requirements apply to all purchases of gold and silver. East-Wing Estate Sales reserves the right to require additional verification prior to release of any gold or silver purchases, regardless of pickup or shipping method.

For gold or silver purchases with a total invoice value over $300, payment must be made by bank wire, Zelle, or cash. Credit cards will not be accepted for these purchases.

For gold or silver purchases with a total invoice value over $2,500, payment must be made by bank wire or cash only.

These requirements apply to all new customers. Customers who have successfully completed purchases of gold, silver, or high-value goods from three (3) or more East-Wing Estate Sales auctions without incident may, at East-Wing’s sole discretion, be permitted to use standard payment methods.

East-Wing Estate Sales reserves the right to hold any gold or silver purchases for up to ten (10) business days for verification purposes prior to release.

BUYER’S PREMIUM
A buyer’s premium will be added to the hammer price of each item. Sales tax is then applied to the invoice total unless a valid resale certificate is already on file.

We require a copy of your resale certificate and the CT resale form (found on our website) to be completed and sent via email prior to tax removal. The information on the resale certificate must match the information on your account for tax to be removed. We cannot remove tax if the information does not match. It is ultimately your responsibility to provide valid documentation.

WARRANTIES
Condition reports are made to the best of our ability but are not guarantees. No employee is authorized to make any warranties, expressed or implied, on behalf of East-Wing Estate Sales, LLC. Items described as “appears to,” “possibly,” “probably,” or “attributed to” are not to be considered a guarantee, but rather the matter of opinion of the auctioneer. No guarantee is made in relation to an item’s condition. All items are sold AS-IS, WHERE-IS. ALL SALES ARE FINAL.

CHARGEBACKS & DISPUTES
Buyers agree not to initiate chargebacks for any reason, including but not limited to non-pickup, storage fees, abandonment, shipping delays, items not received, or items alleged to be not as described.

All items are sold AS-IS, WHERE-IS. Buyer responsibility for pickup or shipping is absolute. Failure to receive an item due to Buyer inaction, missed pickup, shipper failure, or abandonment does not entitle the Buyer to a refund or chargeback. Any chargeback will be contested using these Terms & Conditions, auction records, and platform documentation.

AUCTIONEER’S DETERMINATION
A lot will be sold to the highest bidder as determined at the auctioneer’s sole discretion. The auctioneer has absolute authority to resolve disputes, determine bid validity, reject or challenge any bid or bidding advance, and determine whether to pass, re-offer, or withdraw any lot from sale. The auctioneer’s decision shall be final and binding.

WITHDRAWAL OF PROPERTY FROM SALE
East-Wing Estate Sales, LLC reserves the right to withdraw any property from sale at any time, before or during the auction, for any reason, without liability.

RESCISSION BY PURCHASER
If within thirty (30) days after the sale the original purchaser gives written notice to East-Wing Estate Sales alleging that the age, authenticity, condition, genuineness, quantity, period, culture, source, or origin as set forth in the terms of sale and warranted by East-Wing Estate Sales, as evidenced in the written condition report obtained by the purchaser, were materially inaccurate and misleading and substantially overstated the value of the Property, and returns the Property within five (5) days of receiving authorization in the same condition it was in at the time of sale and proves the truth of such allegations to the satisfaction of East-Wing Estate Sales, the sale of such lot will be rescinded and East-Wing will refund the full purchase price to the purchaser.

Refunds shall not include costs of transportation or shipping, insurance, or other expenses that may have been incurred by the purchaser. After thirty (30) days from the date of purchase (NOT the date of delivery) the guarantee will expire and all items are then sold as-is, where-is and there will be no returns for any reason.

This limited right of rescission is available only to the original purchaser and may not be relied upon by any heir, agent, transferee, assign, or other third party or assigned to any subsequent transferee of the Property which gives rise to the claim.

The purchaser acknowledges and expressly agrees that the provisions of this paragraph state the sole and exclusive remedy available to a purchaser in the event of nonconformity in Property purchased. The purchaser understands and agrees that the exclusive remedy for any breach of the warranty shall be a rescission of the sale and a refund of the original purchase price (bid plus buyer's premium), as well as any applicable taxes paid. Neither East-Wing Estate Sales nor its consignor shall be liable for damages beyond the remedy expressly provided for herein, such as but not limited to, direct, indirect, special, incidental, punitive, or consequential, including the loss of profit or revenue, cost of obtaining alternative property, claims of customers of the purchaser or otherwise.

NO WAIVER
Any accommodation or exception granted by East-Wing Estate Sales in one instance does not constitute a waiver of these Terms or an obligation to grant future accommodations.
